Well, following the discussion on BS and MS grads and some of the members cribbing why the MS(from US) students get special treatment, here are my 2 cents.
1) By makng sure that a person is MS they are making sure the population getting greencard is YOUNG !! , it's simple, highly educated "kids" who understand the US culture, since they have studied in US universities and have a whole life ahead of them to do good in Research etc.
Kids gel in fast for e.g if you see a person with BS and MS from the US, his behaviour is attuned to the society as compared to one who just has a MS and a BS from India.
2) On the other hand someone who has a MTech or worked 10 years in India, chances are these guys are already in their late 30's or 40's, so they are not getting the youth in, or a person who will take a lot more time to gel in the soceity as compared to the student.
3) Most importantly, they can't trust people whose degrees are not from the US. Their quality of education, their authenticity. Also, I think the quality of top 100 US univs, which most indians come to anyway, is much better than most of Indian Univs for MS. The kind of infrastructure and teaching they are exposed to is tremendous.
PS: Someone mentioned that PhD's get paid for reseach. Doing researrch is extremely demanding. I would rate it twice as demanding as a regular job! and the amount the students get is peanuts! Like ~$1500 a month for working ~ 60 hrs a week in research is hell !!
Unfortunately, in doing this you may loose some really good candidates, who may not have a US degree, but thats the price you pay "to be safe than sorry"

On what basis the law suite will be ? i guess they we are not entitled to get GC's, its a privilege but not a right, i agree this whole GC crap is costing our families in all forms, but still, the idea of law suit doesn't have merit.

out of 45K members let's assume 22.5 K are EB2 and 22.5 K are EB3.
Even If 11.25K (EB2)+11.25K (EB3) = 22.5 K (Total) contributes $25 Each Problems gets solved ... but the catch is ....
Even 11.25 K EB2 members are not contributing because they don't have to as their problem is solved
Even 11.25 K EB3 members are not contributing because they are not sure even with this contribution their problems gets solved.
Many people are saying that EB3 members are not contributing that's why you are lagging etc...
EB3 Members who contributed are feeling the pain because even after contribution they are not getting the results and EB2 members who didn't contributed are getting the results...

Let's face it EB2 will likely become current sometime in 2012 (per Q and Teddy in other thread), no one is ever predicting this to happen for EB3 barring law change. IF you are in such a big hole, you will have to come forward and work for yourself. We want others to work for us and solve our problems. That is my issue here. With 11.25 K EB3 members we would have still collected quarter million bucks.(@ 25$/person) If EB3-I does not care for itself, why would anybody else give a damn? (PS : I did contribute for the drive as I want everybody's issues with respect to GC resolved, not just mine)

Also, if you have an advanced degree from an acredited university outside US AND have been working for 3 years in a related field, you will also be exempt from the cap regardless of whether you are applying/have applied in EB2 or EB3 (believe me...you would think that people with advanced degrees would have applied in EB2...but there are cases where people have had to apply in EB3 category even with an advanced degree).
I am not sure about that. Most of the EB3 guys have advance degrees (including me) but not necessarily with US degrees.

If you think , by asking foreign born workers to go back you can get more access to the so called "wealth" you are talking about , its time you enroll for an Economics 101 . It is your proud America that has long been shouting from the rooftops about the need to have more open borders, facilitate global transfer of knowledge and commodities . Anyway , I dont think I have to even argue with you as you need lots of orientation before I get into a meaningful debate with you . You are in this society for 35 years, so I'm not sure what's your objective of being on this forum...Anyway about your observation on Visa spill over, what you are saying is 180 different tha what other lawyers are saying, they are saying until 2007 DOS was reading the law differently so India was getting the spillover Visas, now they have started reading it differently hence India is not getting more than 7% Visas now, it is very obvious, from EB-3 India being in Oct-2001 for last 2 years, and EB-2 haven't seen any substantial movement either....

If someone is from USA and they go to your country and live there for five years; they do not have historical context of why things are done the way they are done; no matter how long they research it.

Even If this happens, it will not help EB3I because then the spill over will be shared by all countries in EB3. Then there will not be any option left both for EB2 and EB3. Now atleast there is an option for some EB3 folks to move to EB2.
Don't worry EB2 Dude! Nothing is going to happen. You will still enjoy the enhanced status that you currently have. The EB3 folks like myself have far too much lethargy/timidness to do anything. The fact that they are still in EB3 after so many years is proof of that. :D

I applied on July2,got the receipt on Aug 22 nd.Got EAD,AP.
One strange thing is my case is NSC to CSC but still in CSC only .I think except my case,all others cases transfred back to NSC.I do not know the reason.

I got an email today from USCIS stating this
Current Status: Card production ordered.
I did not receive any other approval notice. I hope this means that our 485 is approved and the cards have been ordered ?

I think IV needs to hire a good immigration attorney. May be IV can start a new funding drive to see, if members are really interested this hiring an attorney. The same attorney also can help us by answering our questions.
